ಬೆಂಗಳೂರು: ಇಬ್ಬರು ಐಪಿಎಸ್ ಅಧಿಕಾರಿಗಳಾದ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಹಾಗೂ ಡಿ.ರೂಪಾ ನಡುವೆ ನಡೆಯುತ್ತಿರುವ ಸೇಫ್ ಸಿಟಿ ಟೆಂಡರ್ ಹಗರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸೋರಿಕೆಯಾದ ವರದಿ ಸಾಕ್ಷಾಟಿವಿಗೂ ಲಭ್ಯವಾಗಿದೆ.
ಸೇಫ್ ಸಿಟಿ ಟೆಂಡರ್ ಪ್ರಕರಣ ರಾಜ್ಯ ಬಿಜೆಪಿ ಸರ್ಕಾರವನ್ನು ಇಕ್ಕಟ್ಟಿಗೆ ಸಿಲುಕಿಸಿದ್ದು, ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಪ್ರತಿಪಕ್ಷ ಕಾಂಗ್ರೆಸ್ ವಾಗ್ದಾಳಿ ನಡೆಸಿದೆ.
ಐಪಿಎಸ್ ಅಧಿಕಾರಿಗಳ ನಡುವೆ ನಡೆಯುತ್ತಿರುವ ಮುಸುಕಿನ ಗುದ್ದಾಟವನ್ನು ಬಗೆಹರಿಸಲು ಸರ್ಕಾರ ವಿಫಲವಾಗಿದೆ ಎಂದು ಆರೋಪಿಸಿದೆ.
ಈ ನಡುವೆ, ನಿರ್ಭಯಾ ಟೆಂಡರ್ ಅಕ್ರಮ ಆರೋಪಕ್ಕೆ ಸಂಬಂಸಿದಂತೆ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಹಾಗೂ ಡಿ.ರೂಪಾ ನಡುವೆ ಸ್ಪಷ್ಟನೆ, ಆರೋಪಗಳು ಮುಂದುವರೆದಿವೆ.
ಗೃಹ ಕಾರ್ಯದರ್ಶಿ ಡಿ.ರೂಪಾ ವಿರುದ್ಧ ಬೆಂಗಳೂರು ನಗರ ಹೆಚ್ಚುವರಿ ಪೊಲೀಸ್ ಆಯುಕ್ತ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್, ಸರ್ಕಾರದ ಮುಖ್ಯಕಾರ್ಯದರ್ಶಿ ಟಿ.ಎಂ ವಿಜಯ್ ಭಾಸ್ಕರ್ಗೆ ಪತ್ರ ಬರೆದಿದ್ದರು. ಇದರಿಂದ ಆಕ್ರೋಶಗೊಂಡ ಡಿ.ರೂಪಾ ಅವರೂ ಕೂಡ, ವಿಜಯ್ ಭಾಸ್ಕರ್ ಅವರಿಗೆ ಪತ್ರ ಬರೆದು ನಿರ್ಭಯಾ ಸೇಫ್ ಸಿಟಿ ಟೆಂಡರ್ ನಲ್ಲಿ ಆದ ಅಕ್ರಮಗಳು, ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಯಾಕೆ ತಮ್ಮ ಮೇಲೆ ಕ್ಷುಲ್ಲಕ ಕಾರಣಕ್ಕೆ ಆರೋಪ ಮಾಡಿದ್ದಾರೆ ಎಂಬುದರ ಕುರಿತು ಎರಡು ಪುಟಗಳ ಪತ್ರ ಬರೆದಿದ್ದರು.

ನಾನು ಗೃಹ ಕಾರ್ಯದರ್ಶಿಯಾಗು ಬಂದ ಮೇಲೆಯೇ ಐಎಂಎ ಹಗರಣದಲ್ಲಿ ಓರ್ವ ಆರೋಪಿಯಾಗಿರುವ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಮೇಲೆ ಈ ಕೇಸಿನಲ್ಲಿ ಮುಂದಿನ ಕಾನೂನು ಕ್ರಮಕ್ಕೆ ಅನುಮೋದನೆ ದೊರೆತಿದೆ. ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ಮೇಲ್ವಿಚಾರಣೆಯೊಂದಿಗೆ ಐಎಂಎ ಹಗರಣದ ಕುರಿತಾಗಿ ಸಿಬಿಐ ಕಳೆದ ಡಿಸೆಂಬರ್ 2019ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಪತ್ರ ಬರೆದು ಕಾನೂನು ಕ್ರಮಕ್ಕೆ ಕೇಳಿದ್ದರೂ, ಆ ಕುರಿತು ಯಾವ ಬೆಳವಣಿಗೆ ಆಗಿರಲಿಲ್ಲ. ನಾನು ನಿಮ್ಮ ಗಮನಕ್ಕೆ ಈ ವಿಚಾರ ತಂದು ಒಪ್ಪಿಗೆ ಪಡೆದು ಮುಂದುವರಿದ ಮೇಲೆ, ಐಎಂಎ ಹಗರಣದಲ್ಲಿ ಭಾಗಿಯಾಗಿರುವ ಪೊಲೀಸ್ ಅಧಿಕಾರಿಗಳ ವಿರುದ್ಧ ಕಾನೂನು ಕ್ರಮಕ್ಕೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಅನುಮೋದನೆ ನೀಡಿತು.

He has been misleading Govt, press and public. Here are two letters– one Order( Office Memorandum) from Govt Of India, to not finalise the tender without addressing the complaints/ allegations.
There is also a letter by Vigilance Wing of Government seeking report from Tender Committee on irregularities.
Hence, there needs to be an inquiry into the role of Mr Hemant Nimbalkar IPS in the whole process.

Note that even in latest tender [Call 3] which is presently ONLINE in eProcurement portal, the following gross irregularities exist
(1) As per Finance Dept standard bid document KW4 for such tenders, minimum annual turnover of biddee must be 2-times the value of tender. Here tender value is Rs 620 Crores but minimum turnover fixed is Rs 250 Crores. Even with latest amendment the minimum requirement is 100% of tender value or amount payable in first year. Even that is about Rs 500 Crores. So clear cut violation of direction of Finance Dept.
(2) BEL is the Navratna that has expertise in this work as floated in tender ( installation of cctv) . It has repeatedly complained that this is done to favour individual particular vendors. It has brought out how the vendor that was favoured was giving Chinese cameras that is unsafe for security.
(3) Further, as per Rule 3 Karnaraka Transparency in Public Procurement ( herein referred to as KTPP) Rules ,this tender is “Supply of goods and services” tender, because it is about cctv procurement and installation. This is NOT a “Consultancy Services” tender.
(4) But as per Rule 28H of KTPP Rules only for “Consultancy Services” QCBS – Quality cum Cost Based Selection – method can be used. It is not permitted to be used for this tender. Hence the KTPP Rules violated by Tender.
(5) Rules 28H KTPP Rules prescribe that standard bid document must be used. But neither KW4 or KW5 – standard bid document – issued by Finance Dept not used.
The violations of KTPP Act and Rules are endless.
These irregularities make it all the more necessary to investigate into the role of Mr Hemant Nimbalkar IPS, the chairman of tender inviting Committee and tender scrutiny Committee, who has been misguiding the higher authorities in the Government.

ಟೆಂಡರ್ ಗೆ ಬಿಇಎಲ್ ಬಿಡ್ ಮಾಡಿರಲಿಲ್ಲ: ನಿಂಬಾಳ್ಕರ್
ನಿರ್ಭಯಾ ಸೇಫ್ ಸಿಟಿ ಟೆಂಡರ್ ಮಾಹಿತಿ ಸೋರಿಕೆ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಬಿಇಎಲ್ ಬಿಡ್ ಮಾಡಿರಲಿಲ್ಲ ಎಂದು ಹೆಚ್ಚುವರಿ ಪೊಲೀಸ್ ಆಯುಕ್ತ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಸ್ಪಷ್ಟನೆ ನೀಡಿದ್ದಾರೆ.
ನಿರ್ಭಯಾ ಸೇಫ್ ಸಿಟಿ ಪ್ರಾಜೆಕ್ಟ್ ಸಂಬಂಧ ಸಾಮಾಜಿಕ ಜಾಲತಾಣಗಳಲ್ಲಿ ಹಲವಾರು ಊಹೆಗಳು ಹರಿದಾಡುತ್ತಿವೆ. ಟೆಂಡರ್ ಪ್ರಕ್ರಿಯೆ ಅನ್ಫೇರ್ ಎಂದು ಟೀಕಿಸುತ್ತಿದ್ದಾರೆ. ಆದರೆ ಸರ್ಕಾರವು ಸ್ಟೇಟ್ ಲೆವೆಲ್ ಅಪೆಕ್ಸ್ ಕಮಿಟಿ (ಉನ್ನತ ಸಮಿತಿ) ಟೆಂಡರ್ ಇನ್ವೈಟಿಂಗ್ ಕಮಿಟಿ(ಟೆಂಡರ್ ಆಹ್ವಾನ ), ಟೆಂಡರ್ ಸ್ಕ್ರೂಟನಿಂಗ್ ಕಮಿಟಿ(ಟೆಂಡರ್ ದಾಖಲೆಗಳ ಪರಾಮರ್ಶೆ) 3 ಹಂತಗಳಲ್ಲಿ ಕಮಿಟಿ ಸಮಿತಿಗಳನ್ನು ರಚಿಸಿತ್ತು.
ಆದರೆ, ಟೆಂಡರ್ ನಲ್ಲಿ ಬಿಇಎಲ್ನ್ನು ಅನರ್ಹಗೊಳಿಸಲಾಗಿದೆ ಎಂಬ ಆರೋಪ ಕೇಳಿ ಬಂದಿದೆ. ಆದರೆ, ಕಾಲ್ ಒನ್ ಟೆಂಡರ್ನಲ್ಲಿ ಬಿಇಎಲ್ ಬಿಡ್ ಮಾಡಿರಲಿಲ್ಲ. ಟೆಂಡರ್ ನಲ್ಲಿ 3 ಕಂಪನಿಗಳು ಭಾಗಿಯಾಗಿದ್ದವು. ಮೊದಲ ಹಂತದಲ್ಲಿ ಆ ಕಂಪನಿಗಳು ಅರ್ಹತೆ ಪಡೆದಿರಲಿಲ್ಲ. ಬಳಿಕ ಜೂನ್ 20ರಂದು 3 ಕಂಪನಿಗಳು ಕ್ವಾಲಿಫೈ ಆಗಿದ್ದವು ಎಂದು ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಸ್ಪಷ್ಟನೆ ನೀಡಿದ್ದಾರೆ.

ಸೇಫ್ ಸಿಟಿ ಟೆಂಡರ್ ನಲ್ಲಿ ಸಾಕಷ್ಟು ಅಕ್ರಮಗಳು ನಡೆದಿವೆ. ಸರ್ಕಾರಕ್ಕೆ ಈ ಬಗ್ಗೆ ತಪ್ಪು ಮಾಹಿತಿ ಸಲ್ಲಿಕೆಯಾಗಿದೆ. ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ಸರ್ಕಾರದ ದಾರಿ ತಪ್ಪಿಸುತ್ತಿದ್ದಾರೆ ಎಂದು ಗೃಹ ಕಾರ್ಯದರ್ಶಿ ಡಿ.ರೂಪಾ ಮತ್ತೆ ಆರೋಪಿಸಿದ್ದಾರೆ.
2 ಬಾರಿ ಟೆಂಡರ್ ರದ್ದತಿಗೆ ಕಾರಣವಾದ ದೂರಿಗೆ ನಿಂಬಾಳ್ಕರ್ ಉತ್ತರಿಸಿಲ್ಲ. ಬೃಹತ್ ಮೊತ್ತದ ಟೆಂಡರ್ ನಲ್ಲಿ ಭ್ರಷ್ಟಾಚಾರ ಮಾಡಿದ್ದಾರೆ. ಈ ಟೆಂಡರ್ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಸಾಕಷ್ಟು ಅಕ್ರಮಗಳು ನಡೆದಿವೆ. 4500 ಕೋಟಿ ಐಎಂಎ ಹಗರಣದಲ್ಲಿ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ವಿರುದ್ಧ ಸಿಬಿಐ ಚಾರ್ಜ್ಶೀಟ್ ಸಲ್ಲಿಸಿದೆ. ನಿರ್ಭಯಾ ಸೇಫ್ ಸಿಟಿ ಯೋಜನೆಯ ಇಡೀ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಹೇಮಂತ್ ನಿಂಬಾಳ್ಕರ್ ವಹಿಸಿದ ಪಾತ್ರದ ಬಗ್ಗೆ ತನಿಖೆ ನಡೆಸಬೇಕಾಗಿದೆ ಎಂದು ಪತ್ರಿಕಾ ಪ್ರಕಟಣೆಯಲ್ಲಿ ಆಗ್ರಹಿಸಿದ್ದಾರೆ.
